Sumario:The paper provides a critical analysis of the legal framework governing expropriation in Ecuador, highlighting the tensions between the administrative power of expropriation and the guarantees of property rights within the constitutional State based on the rule of law. On one hand, it examines the inadequate normative placement of the expropriation power within the Organic Law of the National Public Procurement System and its diffuse attribution to all types of public entities, which undermines the legitimacy and objectivity of its exercise. On the other hand, at the judicial level, it identifies a rupture in the right to effective judicial protection, as the declaration of public utility remains immune from judicial review and judgments on the determination of just compensation are not subject to appeal. Finally, it analyzes the institution of reversion, whose protective character is weakened by the broad administrative discretion granted by law. The study concludes by proposing a structural reform of the expropriation regime to restore the balance between the public interest and the effective protection of property rights.
