Sumario:For some years it has been presented in Colombia a return to administrative law for state entities with an exceptional contractual regime. This paper analyses their duty to process the contract in SECOP II or in the transactional platform that takes its place, arguing that this procedural mandate expresses that tendency, because it restricts freedom in a manner that governs, generally, in private law, and maximizes the guarantee of principles largely developed by administrative law, such as publicity and transparency. Likewise, the text studies the challenges to which the use of said electronic platform by such entities is subject, specifying that it is a transactional tool and not simply advertising.
