La Constitución argentina reformada en 1994 incorporó los denominados “derechos ambientales” en el apartado de nuevos derechos y garantías. En este trabajo se presenta una lectura política de la Constitución a partir de las imágenes que la narrativa constitucional propone en cuanto a la relación sociedad-ambiente. Se pondrá especial interés en el contexto de argumentación y de emergencia de la nueva Constitución, caracterizado por la expansión de los conflictos socio-ambientales distributivos que resistieron al neo-extractivismo. Abordaré el tema desde un marco de comprensión crítico que articula conceptualizaciones del pensamiento de liberación y de la ecología política latinoamericana.ABSTRACTThe Argentine Constitution, reformed in 1994, incorporated the so-called "environmental rights" in the section on new rights and guarantees. This paper presents a political reading of the Constitution based on the images that the constitutional narrative proposes regarding the society-environment relationship. Special interest will be placed on the argumentation and emergency context of the new Constitution, characterized by the expansion of distributive socio-environmental conflicts that resisted neo-extractivism. I will approach the subject from a framework of critical understanding that articulates conceptualizations of liberation thinking and Latin American political ecology. |
