Law; Penal Prosecution Law constitutionality; prison; resocialization; Viatri; social rehabilitation Derecho; Derecho de Ejecucción Penal constitucionalidad; prision; resocialización; Viatri; rehabilitación social This paper concern comes from thinking if is constitutionally and legally sustainable the imprisonment in the case where the subject lifestyles conditions outwardly the criminal process change, thereafter the event, previously to the prosecution and penalty, so the rehabilitation/resocialization become unnecessary.The conclusion from the current regulations analysis is that punishment purposes are: security (negative special prevention) and resocialization (positive special prevention), if these objectives are achieved by other than criminal prosecution means, the sentence of imprisonment loses its rationale.What happens with additional penalties and compensation into the civilian plane, are different matter, which are sustained by other fundaments.If a subject changes the lifestyle, and by those conditions spares the state's need for social rehabilitation, are not reasons for punishing by deprivation of liberty.However, the unnecessary requirement for a sentence of imprisonment or confinement, accessory penalties are not affected and should be applied.Also civil indemnities maintain their full force regarding this subject.Review over the Viatri Case. La inquietud de este trabajo surge de pensar si es sustentable constitucionalmente y legalmente la pena de prisión en el caso en que las condiciones de vida de un sujeto externas al proceso penal, posteriores al hecho y anteriores al proceso y a la aplicación de la pena, de tal manera que hagan innecesaria la rehabilitación/resocialización.Del análisis de la normativa vigente se concluye que los fines de la pena son la seguridad (prevención especial negativa) y la resocialización (prevención especial positiva), si estos fines son alcanzados por otros medios distintos del proceso penal la pena privativa de libertad deja de tener su razón de ser. Cos distinta es lo que sucede con las penas accesorias y las indemnizaciones en el plano civil, las cuales se sostienen por otros fundamentos. Si un sujeto cambia sus condiciones de vida, y por esas condiciones salva la necesidad del estado de rehabilitarlo socialmente, no se motivos para que deba ser castigado con la privación de su libertad.No obstante la innecesariedad de la pena de prisión o reclusión, las penas accesorias no se ven afectadas y deben ser aplicadas.Así también las indemnizaciones civiles mantienen todo su vigor respecto se este sujetoReflexión sobre el caso Viatri.
