Speaking of juvenile justice or juvenile criminal justice refers to very different patterns of thought, institutional and political articulations. However, it is common to find, in the training processes of different disciplines such as law and specifically social work, the special recurrence to a stereotyped conceptual framework that reduces the issue of the rights of girls, boys and adolescents to two paradigmatic positions: the paradigm of the irregular situation and the paradigm of comprehensive protection. Talking about paradigms refers to the Khuntian epistemological position, which we will discuss in the framework of this work as long as it does not result in a conception about the development of knowledge that we share. In Latin America, this way of conceiving changes in the field of justice has reduced the problem of juvenile justice around the prevailing idea of the need for legal and procedural changes, subsuming the discussions only to the legal-normative order. Choosing to broaden these discussions implies challenges for forensic social work (TSF), which are assumed from the restorative approach that we adopt. El objetivo de este artículo es desnaturalizar la instalación acrítica del discurso punitivo en materia de justicia juvenil. Hablar de justicia juvenil o justicia penal juvenil remite a matrices de pensamiento, articulaciones institucionales y políticas muy diferentes. Es frecuente hallar, sin embargo, en los procesos de formación de distintas disciplinas como el Derecho y específicamente el Trabajo Social, la especial recurrencia a un marco conceptual estereotipado que reduce la cuestión de los derechos de niñes y adolescentes a dos posiciones paradigmáticas: el paradigma de la situación irregular y el paradigma de la protección integral. Hablar de paradigmas remite a la posición epistemológica khuntiana que discutiremos en el marco de este trabajo, en tanto no resulta una concepción sobre el desarrollo del conocimiento que compartamos. En América Latina, esta forma de concebir los cambios en el campo de la justicia ha reducido la problemática de la justicia juvenil en torno a la idea predominante de la necesidad de cambios legales y procesales, subsumiendo las discusiones solo al orden jurídico-normativo. Optar por ampliar estas discusiones implica desafíos para el Trabajo Social forense que son asumidos desde el enfoque restaurativo que adoptamos. Universidad Nacional de Rosario.
