description This presentation collects some of the developments of the final work done for the Postgraduate Course of Specialization in Clinical, Institutional and Community Psychology. It addresses the results of the Inter–ministerial Program for the Substitution of Psychiatric Logics; it has been carried out in the Province of Santa Fe since 2012. The purpose is to review the chronic hospitalizations in mental health in private and public institutions in the province. It seeks to promote an individual tailor health system in order to strength the implementation of the mental health policy established in the Provincial Mental Health Act 10772/91, its Regulatory Decree /2007 as well as the National Law on Rights to Mental Health Protection Nº 26657/10 and its Regulatory Decree/2013 in accordance with the International Human Rights Treaties with constitutional basis. A general analysis of the results of this inter–ministerial report leads us to consider that there is currently a transition period that ranges from accommodation modalities still characterized by confinement and guardianship of patients in treatment –in institutions where prolonged confinement is presented as a fundamental strategy for addressing subjective sufferings–, to strategies that respect human rights –where placement in specific institutions is not prohibited, but it is established that they must respect the dignity of patients, considering them as protagonists of their own destiny and not subject to manipulation and/or arbitrary impositions.

Esta presentación retoma algunos de los desarrollos del trabajo final realizado para la Carrera de posgrado de Especialización en Psicología Clínica, Institucional y Comunitaria. Aborda los resultados del Programa interministerial de Sustitución de Lógicas Manicomiales que se desarrolla en la Provincia de Santa Fe desde el año 2012, cuyo propósito es revisar las internaciones crónicas en salud mental en clínicas privadas y públicas de la provincia. El mismo tiene como fundamento propiciar un sistema único de salud y fortalecer la implementación de la política de salud mental establecida en la Ley Provincial de Salud Mental Nº 10772/91, su Decreto Reglamentario /2007 así como en la Ley Nacional de Derechos a la Protección de Salud Mental Nº 26657/10 y su Decreto reglamentario/ 2013 de acuerdo con los Tratados Internacionales de Derechos Humanos con raigambre constitucional. En este marco normativo, los establecimientos de salud mental públicos y privados en carácter de prestadores del IAPOS –Instituto Autárquico Provincial de Obra Social– con afiliados internados en forma crónica, rubricaron un convenio para la implementación del mencionado programa. Un análisis general de los resultados de este trabajo interministerial lleva a considerar que actualmente se presenta un período de transición que va desde modalidades de alojamiento aún caracterizadas por el encierro y la tutela de los pacientes en tratamiento (en instituciones donde el encierro prolongado se presenta como estrategia fundamental para el abordaje de los padecimientos subjetivos), hasta estrategias respetuosas de los derechos humanos donde no se prohíbe la internación en instituciones específicas, sino que se establece que estas deben respetar la condición de sujetos de los pacientes y su dignidad, considerando a estos protagonistas de su propio destino y no objeto de manipulaciones y/o imposiciones arbitrarias.
