Sumario:The present essay takes the phenomenological and Husserlian concept of Vergemeinschaftung in order to examine the possibility of a free renounce to the community. Trough empathy and its intuitive source it develops a first investigation related to fulfilment and monadology. As a continuation it analyses the freedom character of volition to show the tension between static and genetic phenomenology within the background of the Vergemeinschaftung. Trough the study of some manuscripts in Leuven it concludes the following statement: the freedom of volition in the phenomenological ethical background is outlined by a noticeable genetic phenomenology, and hence, passive. What shows the possibility of developing genetic phenomenological exercises linked to intersubjectivity to know more about social phenomena as the juridical structure of normative communities.
