description Based on the idea that, in Latin America, the concept of indigenous operates, among other things, as a legal category, the aim of this article is to reflect, from an anthropological point of view, on the legal structure deployed by the Jujuy province Parliament during the 80´s, widely considered as the decade of the return of democracy and development of neoliberalism in Argentina. The focus on the legal discourse through the analysis of the ensemble of bills introduced in the provincial Parliament between 1983 and 1989, dealing (either directly or indirectly) with the indigenous populations of the province, and more specifically the Quebrada and Puna communes, allows us to put into context one of the main fields in which the interaction between the State and those communities takes place and, by that, to think about the building process of the legally allowed indigenous in that period, taking into consideration that the legal structure weaved throughout the time by political/economical threads establishes and defines the limits (legal borders) of identities legality/legitimacy.  What does the Provincial State consider as indigenous when, in different contexts, deals (through laws, decrees and resolutions) with the difficulties of the indigenous populations? Which are the main topics composing this legal structure? Far from being only rhetorical, these questions are critical and allow us to look into the legal (re)setting of identities and the conflicts around which this setting lays.

Partiendo de la idea de que en América Latina lo indígena opera entre otras cosas, como una categoría jurídica, este trabajo pretende reflexionar, desde una mirada antropológica, sobre la estructura jurídica desplegada por la Legislatura de la provincia de Jujuy durante los años `80 (periodo considerado de retorno a la democracia y desarrollo del neoliberalismo en la Argentina). Abordar los discursos jurídicos mediante el análisis del total de proyectos de ley presentados en la Legislatura provincial durante los años 1983-1989, que involucran (directa o indirectamente) a las poblaciones indígenas de la provincia -más específicamente de las localidades ubicadas en la Quebrada y Puna-, permitirá contextualizar uno de los principales campos en los que se produce la interacción entre el Estado y dichas poblaciones y por lo tanto, reflexionar sobre el proceso de composición del indígena legalmente permitido en dicho periodo; ya que la estructura jurídica que se teje a lo largo del tiempo con hebras político-económicas, establece y define los límites (márgenes jurídicos) de la legalidad/legitimidad de las identidades. ¿Qué entiende por indígena el Estado provincial cuando en diferentes contextos aborda –a través de leyes, decretos y resoluciones- la problemática de las poblaciones indígenas que habitan en las distintas regiones de la provincia de Jujuy? ¿Cuáles son los principales tópicos que componen esa estructura jurídica? Lejos de ser preguntas retóricas, se trata de interrogantes cruciales que permiten indagar sobre la (re)configuración jurídica de las identidades y los conflictos sobre los que se asienta dicha configuración.
