Sumario:The paper analyzes the public measures to promote technological innovation, in the federal Constitution of Brazil, as of Constitutional Amendment n° 85. The study is carried out through a critical approach to the legitimacy of Law and State action. The objective is to determine, based on the democratic principle and other constitutional provisions, the attitudes that the State must assume based on the cooperative role foreseen in the federal Constitution, in relation to technological innovation for the satisfaction of the common good. We study aspects related to the role of the State in the market economy, within the framework of the current technological development, linked to the fundamental rights.
