The decision in question is based on local norms and international instruments of constitutional rank that emphasize the protection of persons with disabilities by granting them rights and obligations in order to integrate them in an equal way to the rest of the inhabitants. El presente trabajo se vincula al análisis del caso jurisprudencial que se adjunta al presente, dictado en el año 2007, en el que el Tribunal rechaza el pedido de declaración de inhabilitación solicitado por la madre a un joven mayor de edad con síndrome de Down, declarando su incapacidad parcial para determinados actos. El fallo en cuestión se funda en normas locales e instrumentos internacionales de rango constitucional que hacen hincapié en la protección de personas con discapacidad, otorgándoles derechos y obligaciones a fin de integrarlas de forma igualitaria al resto de los habitantes.
