Sumario:The present work is linked to the analysis of the case law annexed to the in the year 2007, in which the Court rejects the request for the declaration of the of disqualification requested by the mother to a young adult with syndrome of Down, declaring his partial incapacity for certain acts. The decision in question is based on local norms and international instruments of constitutional rank that emphasize the protection of persons with disabilities by granting them rights and obligations in order to integrate them in an equal way to the rest of the inhabitants.
