The victory of the privacy over the safety and the public order invoked by the State, was result of the declaration of unconstitutionality of the spy law Nº 25873, which provided the general intervention of all the telephonic communications and e-mails for Internet, recording them for 10 years, violating the right to the intimacy, allowing the information be used by the SIDE for a purpose other than the intended by the legislator, without judicial control guaranteed by the articles 18 and 19 of National Constitution and international treaties with constitutional status. The judgement imposed limits on state power and restored the freedom as a constitutional value. El trabajo analiza la operatividad del artículo 43 de la Constitución Nacional, garantizando la privacidad e intimidad de los habitantes de la Nación Argentina, por medio de la Acción de Clase en el caso Halabi, sentenciado por la Corte Suprema de Justicia de la Nación, con su efecto expansivo de alcance general. La victoria de la Privacidad sobre la seguridad y el orden público pretendidas por el Estado relacionadas con la declaración de inconstitucionalidad de la ley espía Nº 25873, que dispuso la intervención general de todas las comunicaciones telefónicas y correos electrónicos por Internet, grabándolos por 10 años, violando el derecho a la intimidad cuando los datos podían ser usados por la SIDE para una finalidad distinta de la perseguida por el legislador y sin control judicial, garantizado por los art. 18 y 19 de la Constitución Nacional y por los Tratados internacionales con rango constitucional, imponiéndole límites al poder del Estado y rescatando la libertad como valor constitucional.
