In this regard, the Civil and Commercial Code of the Nation (hereinafter CCyC) establishes in article 2643 as a general principle that said jurisdiction is assigned to Argentine judges by the last domicile of the deceased or by the location of real estate in the country with respect to them. In other words, this means that the Argentine judges will have jurisdiction if the properties are located in our territory, but they will only be able to deal with the succession regarding them, if the domicile of the deceased was abroad. In this context, it is affirmed that the jurisdiction in CCyC does not correspond solely and exclusively to the judges of the last domicile of the cujus, but rather the criterion of the patrimonial forum is consecrated, recognizing the prevailing doctrinal and jurisprudential criterion on the subject. El presente trabajo pretende abordar el examen de la competencia internacional y su extensión cuando se abren procesos  sucesorios por la sola circunstancia de la existencia de bienes inmuebles situados en el país. Al respecto el Código Civil y Comercial de la Nación (en adelante CCyC) establece en el art. 2643 como principio general que dicha competencia le viene asignada a los jueces argentinos por el último domicilio del causante o por el lugar de situación de bienes inmuebles en el país, respecto de éstos. En otras palabras, ello significa que los jueces argentinos tendrán competencia si los inmuebles se encuentran situados en nuestro territorio, pero solamente podrán entender en la sucesión respecto de ellos, si el domicilio del causante se hallaba en el extranjero. En este contexto, se afirma que la jurisdicción en CCyC no corresponde única y exclusivamente a los jueces del último domicilio del cujus, sino que se consagra el criterio del foro patrimonial, reconociendo el criterio doctrinal y jurisprudencial imperante en el tema.
