It is not intended to defend the reasonableness of that period, but to demonstrate that the Solicitor of the Treasury’s decisions regarding this issue suffer from several shortcomings which make its subsequent decisions invalid. One of the main assumptions of this interpretation will be specially refuted: the fact that the executive power has the ability to not to fulfill a Law because it is considered as unconstitutional. El presente trabajo lleva a cabo un análisis crítico de la doctrina sostenida desde el año 2002 por la Procuración del Tesoro de la Nación con relación a que el artículo 38 de la Ley Marco de Regulación del Empleo Público Nacional -que establece un plazo máximo de seis meses para sustanciar un sumario administrativo- sería inaplicable por inconstitucional. No se pretende defender la razonabilidad de uno u otro plazo sino demostrar que los dictámenes producidos por el máximo órgano asesor del Poder Ejecutivo Nacional adolecen de graves defectos que tornan inválidos sus argumentos y las conclusiones posteriores emanadas de ellos. Se discute con especial énfasis uno de los presupuestos de esta interpretación, que es la facultad de la Administración de no aplicar una Ley por considerarla inconstitucional.
