The economic, social and cultural rights are a clear example of this situation that is because they have developed from their recognition as international instruments to an effective protection at both national and international level. In this context this essay analyses the reception of these rights in the National Justice Supreme Court by the examination of one of the most recent cases on this subject: “A.T.E c/ Municipalidad de Salta s/ Recurso de Hecho”, 18th of June, 2013. El derecho internacional de los derechos humanos ha evolucionado vertiginosamente desde su consolidación a mediados de siglo XX. Un ejemplo claro de ello lo constituyen los derechos económicos, sociales y culturales que han avanzado desde el mero reconocimiento en instrumentos internacionales hasta lograr una protección efectiva tanto en el ámbito internacional como en el ámbito interno. En este contexto, este trabajo analiza la recepción que estos derechos han tenido en la jurisprudencia de la Corte Suprema de Justicia de la Nación mediante el examen de uno de los más recientes pronunciamientos que este órgano judicial ha tenido en la materia: “A.T.E c/ Municipalidad de Salta s/ Recurso de Hecho”, de 18 de junio de 2013.
