The province of Jujuy is not away from this situation, despite this, at the beginning of 2013 a new law concerning to the preservation of the natural and cultural heritage was passed, so the one dated in 1982, Nº 3866, was derogated. The present study is focused on the analysis of the legislation considering the historical and social situation when the first laws as well as the present ones were passed in the national and provincial position of Jujuy. Besides, the implementation of the present law and the real case happening in this province such as quebrada de La Cueva situated in the northern part of the Humahuaca Region will be regarded. La protección del patrimonio arqueológico de nuestro país es aún un tema pendiente en la agenda. La provincia de Jujuy no se encuentra exenta de ello. Pese a eso, a principios del 2013 se sancionó una nueva ley de protección del patrimonio cultural y natural, quedando derogada la Ley Nº 3866 de 1982. El presente trabajo se centra en el análisis de esta normativa considerando la situación social e histórica de los momentos en que se promulgaron las primeras leyes y las actuales, en el plano nacional y provincial de Jujuy. Además se considera la aplicación de la presente ley en relación a un caso específico de dicha provincia: la quebrada de La Cueva, ubicada en el sector norte de la Quebrada de Humahuaca (departamento de Humahuaca).
