| Sumario: | The article reviews the political and legislative process that has followed same-sex marriage in Mexico. For this, we begin with a brief review of sexual rights under a human rights approach. In Mexico, this process has taken place gradually in different states of the country, through legislative changes and through sentences, criteria and standards of the federal justice system in compliance with the protection and guarantee of the normative principle of non-discrimination (which the Political Constitution recognizes as ius cogens). Likewise, there is evidence of actions in favor of recognition from certain sectors of civil society, as well as some actions for and against by the federal government, which at certain times has hindered and at other times has promoted the protection of rights for the LGBT+ population, tensions that constantly put at risk the achievements that have been made. |
