Sumario:The preventive function of the tort law is fully recognized in our Constitution, in the Civil and Commercial Code of the Nation and in various special laws. The preventive claim must be exercised in accordance with the requirements set forth in the laws, through the procedural channels recognized in the procedural rules of each jurisdiction. The judge is allowed to act ex officio in order to avoid the production of damages or the possibility of their aggravation. The extent of this possibility of acting is determined by the type of damage that is sought to be prevented, since, according to the legal asset that seeks to protect, its powers could be expanded or restricted.
