Once its nature as a collective good has been established, to address the issue of its protection based on the preventive function of tort law according to the rules and principles included in the Civil and Commercial Code of the Nation, in conjunction with the National Constitution, treaties and special laws. El objetivo de este trabajo es conceptualizar al patrimonio cultural e histórico, tanto material como jurídicamente, a partir de las nociones que nos brindan las fuentes del derecho vigente. Una vez establecida su naturaleza como bien colectivo, abordar la cuestión de su protección a partir de la función preventiva del derecho de daños según las reglas y principios receptadas por el Código Civil y Comercial de la Nación, en conjugación con la Constitución Nacional, tratados y leyes especiales.
