En materia de medio ambiente, hoy en el país encontramos jurisprudencia de los tribunales federales con una fuerte tendencia a considerar la contaminación ambiental como delito de peligro - pese a la resistencia de la vieja jurisprudencia acotada a una mirada cerrada del código penal- tal el caso bajo análisis: “Luis Alberto Drube; Santiago Daniel Gasep damnificado Gobierno de Santiago del Estero – La Trinidad” donde se observa una tensión entre ambas corrientes.
