Sumario:Abstract: In this essay, the author, stunned by the excessive breakthrough of the judicial precedent, proposes to identify theoretical and practical reasons for the entity and importance of the phenomenon. She tries to estimate how jurists now value case law, as a source of law, in the case of being removed from the source system in Civil Law. She revises theories pertaining to different systems and resignifies the importance of legal comparison. From Ross’ thesis, she projects on Taruffo the current state of the precedent. She analyzes the confrontation of new paradigms and attempts to establish some kind of order in a chaotic law.
