It decided that it did not, because what was irreducible was not the amount of pension assets but their proportionality, since the opposite would lead to an absurd result. The idea of this paper is precisely to analyze and to criticize the way in which the TSJ uses some interpretative arguments (literal, systematic interpretation, reduction to the absurd, economic emergency, deference to the legislator and proportionality), with the aim of showing that, if properly used, those same arguments do not give support to the decision. En el precedente SEP el Tribunal Superior de Justicia de Córdoba (TSJ) tuvo que analizar si una ley provincial violentaba o no el principio constitucional local de la irreductibilidad de los haberes previsionales. Resolvió que no lo hacía porque lo irreductible no era la cuantía de los haberes previsionales sino su proporcionalidad, ya que lo contrario llevaría a un resultado absurdo. La idea del trabajo es precisamente analizar y criticar el modo en que el TSJ usa ciertos métodos interpretativos (interpretación literal, sistemática, reducción al absurdo, emergencia económica, deferencia al legislador y proporcionalidad), con la finalidad de mostrar que, si usados de manera adecuada, en realidad no apoyan la decisión del tribunal.
