Sumario:Although international human rights covenants leave it to each State regulating the expulsion of foreigners this measure should be appropriate to the purpose of other agreements, which set quite precise obligations in the interest of the international community. The prosecution of illicit drug trafficking in its aggravated form, cannot avoid a penalty, purpose never achieved with the expulsion. It is a legislative that in the case of same crime a person belonging to a drug trafficking organization becomes free but the national is convicted and subjected to stricter conditions.
