This work aims to reverse this situation by making explicit the duties and rights as teachers in the production of virtual materials. When writing this work on the rights and duties of the authors of virtual materials, we found it useful to approach it from the framework provided by the document “Guidelines for Open Educational Resources (OER) in Higher Education”, published by UNESCO 2015. We will make an allusion to the concept of author as it is contemplated in Law 11723 and its modifications. Existe en la producción de materiales virtuales y en especial con Recursos Abiertos un error de los colegas Productores de Material: suponer que, el uso de recursos abiertos no exige el reconocimiento de los derechos de propiedad intelectual, derechos de autor y el respeto a las políticas de privacidad. Este trabajo pretende revertir esa situación explicitando los deberes y derechos como docentes en la producción de materiales virtuales. Al escribir este trabajo sobre los derechos y deberes de los autores de materiales virtuales, nos pareció útil encararlo desde el encuadre que brinda el documento “Directricespara los Recursos Educativos Abiertos (REA) en la Educación Superior”, publicado por UNESCO 2015. Haremos una alusión al concepto de autor tal como está contemplado en la Ley 11723 y sus modificaciones.
