The instruments use the denomination “diplomatic and consular protection”, although their analysis, interpretation and extension cannot departfrom the concepts of Public International Law: diplomatic protection, diplomatic assistance, consular protection and consular assistance.This article analyzes this right both from European Community Law -as a European citizenship right supported by this link / legal status of the European Union-, as well as from Public International Law. It investigates its current normative, doctrinal and jurisprudential scope, and he wonders about its possible future development within the context of the supranational regional integration process such as the European Union. La Unión Europea ha receptado una figura que se denomina “Protección Diplomática y Consular” en el artículo 35 del Tratado de la Unión Europea (TUE) y en los artículos 20.2.c) y 23 del Tratado de Funcionamiento de la Unión Europea (TFUE), como también en el artículo 46 de la Carta de Derechos Fundamentales de la Unión Europea. Los instrumentos utilizan la denominación “protección diplomática y consular”, aunque su análisis, interpretación y extensión no pueden apartarse de los conceptos del Derecho Internacional Público: protección diplomática, asistencia diplomática, protección consular y asistencia consular. Este artículo analiza este derecho tanto desde el Derecho Comunitario Europeo -como un derecho de ciudadanía europeo sustentado en este vínculo/estatuto jurídico propio de la Unión Europea-, como desde el Derecho Internacional Público.Indaga en su actual alcance normativo, doctrinario y jurisprudencial y se interroga sobre su posible futuro desarrollo dentro del contexto del proceso de integración regional supranacional como es la Unión Europea.
